David Robinson Estate Agents Ltd are data controllers and processors of your personal data. We have produced this privacy notice in order to keep you informed of how we handle your personal data. We do not collect any Special Categories of personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union memberships, information about your health and genetic and biometric data) Nor do we collect any information about criminal convictions and offences.

What is ‘Compliance with a legal obligation’?

 

At David Robinson Estate Agents Ltd to operate, we are legally bound to comply with our legal obligations, this can include but not limited to The Property Ombudsman code of practice, Anti-Money Laundering (AML) AND Right to Rent checks.

 

What is ‘Performance of a contract’?

 

Information that we have about you that we have collected for the performance of our contracts, which is required in order for us to successfully fulfil our obligations to you. If you choose not to provide the personal data requested, we will not be able to enter into a contract with you to provide the benefits that we offer.  If we are already processing your personal information under a contract, you must end our contractual relationship (as/where permitted) in order to exercise some of your rights.

 

What are our ‘legitimate interests’?

 

Legitimate interests are a flexible basis which the law permits the processing of an individuals personal data. To determine if we have a legitimate interest in processing your data, we balance the needs and benefits to us against the risks and benefits for you of us processing your data. This balancing is performed as objectively as possible by our Data Protection Lead. You are able to object to our processing and we shall consider the extent to which this affects whether we have a legitimate interest.

 

Who will we share this data with, where and when?

 

Your data will be shared within our company for the purposes of providing a service to you and understanding your use of our products and services.

 

Your data may also be shared with a third-party processor, in line with the ‘Lawful Bases’ to include but not limited to:

 

  • Independent Financial Advisors for advice relating to your affordability / property
  • Solicitors and conveyancing agents for legal advice relating to your property transaction/s
  • AML service providers
  • Any other names party to a signed contract, such as a landlord or tenant
  • Third parties who provide services to the property for maintenance and repairs, to include but not limited to, plumbers, electricians, builders, carpenters, cleaners
  • Surveying companies for surveying services required for the sale / purchase of a property
  • Utility companies where we are required to do so to adhere to a tenancy agreement
  • Right to Rent and Credit Referencing companies to obtain references for letting a property
  • Employers to obtain references for letting a property
  • Management companies whereby a property is situated within a block or grounds that have an third party management company
  • Inventory Providers who facilitate our inventory and inspection software
  • Registered Social Landlords (RSL’s) for specific referrals under the Shared Ownership Scheme

 

Personal data may be shared with government authorities and/or law enforcing officials if required for the purpose of the above, if mandated by law or if required for legal protection of our legitimate interests in compliance with the applicable laws.

 

Personal data will also be shared with third party service providers, who will process it on behalf of David Robinson Estate Agents Ltd to help us run our websites, marketing campaigns and our services to you. Such third parties include providers of identity checking, referencing, database management, accounting, IT and communication services.

 

How Long will we keep your personal data?

 

David Robinson Estate Agents Ltd holds different categories of personal data for different periods of time.  Wherever possible, we will endeavour to minimise the amount of personal data that we hold and the length of time which it is held.

 

Where we process personal data in connection with performing a legal obligation or contract, we will keep the data for 7 years from the last interaction with us.

 

Where we process registration data, we do this for as long as you are an active user of our services and sites and for 7 years thereafter.

 

Where we process personal data for marketing purposes or with your consent, we process the data until you ask for us to stop and for a short period thereafter (to enable us to action your request)  We will also keep a record of the fact that you have asked us not to send you direct marketing or process your date indefinitely so that we can respect your request in the future.

 

What are your rights?

 

  • The right to be informed of how your Personal Data is used, detailed within this notice.
  • The right to access any personal data held about you.
  • The right to rectification of any inaccurate or incomplete personal data held about you.
  • The right to erasure where it cannot be justified that the information is being held is for the purposes laid out within this policy having ability to withdraw consent.
  • The right to restriction for direct marketing purposes and profile building.
  • The right to object to the way that we process your data, to seek justification and to object to your data being processed further where necessary

How can I exercise my rights?

 

You can exercise your about you by contacting David Robinson Estate Agent Ltd, making a ‘subject access request’ (SAR).  This can be requested in any form, face to face, in writing or email, via our social media platforms or website contact form, to any employee within the company.

 

This service is provided free of charge and our Data Protection Lead will be provide a response within one month, in exceptional circumstance this can be extended for a further 2 months.  Your request can be rejected if it is deemed to be excessive or unfounded. If either case, you would be informed in writing of such.

 

SAR’s can be made by a third party for an individual, of which David Robinson Estate Agents is within right to access the creditability of such requests, by way of verifying ID and authority of any third party.  It is worth noting that the response timeframe would not commence until such time satisfactory enquiries had been made in to verifying the request of the third party.

 

Withdrawing consent / opting out of direct marketing

 

Wherever we rely on your consent, you will always be able to withdraw that consent, although we may have other legal grounds for processing your data for other purposes, such as those set out within this notice.  In some cases, we are able to send you direct marketing without your consent, where we rely on our respective legitimate interests.

 

You have the absolute right to opt-out of direct marketing at any time.  You can do this by following the unsubscribe instructions contained in communications or contacting us directly in Branch.

Any changes we may to our privacy notice in the future will be posted on this page and where appropriate, notification will be sent within email communications.
